General Terms and Conditions of Business
1 General
The following terms and conditions apply to all existing and future contractual relationships as of 31.01.2023. Other terms and conditions shall only be binding on us if we have expressly acknowledged them in writing or if they comply with mandatory law.
2 Conclusion of contract
Our offers are non-binding and free, they are only valid as an invitation to submit an offer. Orders shall only become binding when a confirmation of this contract is received from us.
The issue of an invoice to the customer replaces this confirmation.
3. Prices
The prices contained in our shop are current and stated as net sales prices, which do not include a flat rate for shipping and handling.
4. Delivery
We make every effort to meet the delivery dates quoted to our customers.
If we are prevented from delivering by our suppliers or other circumstances, the scheduled delivery date will be extended until the end of the hindrance.
If the delivery is delayed on our part, it is possible for the customer to withdraw from the contract, whereby the grace period of § 323 para. 1 BGB is to be measured at a minimum of 4 weeks.
Compensation on our part shall only be obligated if a grossly negligent or intentional breach of contract can be proven against us or our vicarious agents.
This shall not apply in the case of personal injury, for which we shall be liable within the scope of the statutory provisions.
5 Warranty
If the goods are externally damaged upon
delivery, refuse acceptance.
Incomplete or incorrect delivery as well as recognisable defects must be reported immediately, at the latest within 3 days after receipt of the goods.
For this purpose, a unique delivery note number must be communicated to us in an unambiguous manner.
6. Terms of payment
Payment options offered on our site are: Paypal, direct debit, bank transfer.
If the payment cannot be collected for any reason, the purchase contract becomes invalid.
If the supplier offers payment by direct debit and the customer chooses this payment method, the customer grants the supplier a SEPA basic mandate.
If, in the case of payment by direct debit, a payment transaction is reversed due to a lack of funds in the account or due to incorrectly transmitted bank details, the customer shall bear the costs.
Certain types of payment can be concluded in individual cases with the agreement of the supplier.
The customer is not permitted to pay for the goods by sending cash or cheques.
We are entitled in principle to set off incoming payments against the older items still outstanding.
7 Offsetting
Offsetting by the customer is only permitted with undisputed or legally established counterclaims.
8. Retention of title
Deliveries shall not be made until payment has been received by the supplier.
Should a delivery be clarified via other payment methods in individual cases and this payment has not yet been received, these deliveries will always be made under retention of title in accordance with § 449 BGB (German Civil Code).
After full payment of this invoice, it shall expire.
Our property is to be properly stored and protected against possible theft or damage to the goods.
In the event of damage, insurance claims shall arise which the customer shall assign to us in advance.
The customer shall notify us in the event of unauthorised use by third parties, as well as other unlawful acts, loss and destruction.
9 Applicable law, place of performance and place of jurisdiction
By placing an order, the customer accepts our above general terms and conditions.
Unless otherwise agreed, German law shall apply, also in relation to foreign contractual partners.
In business transactions with fully qualified merchants, the place of jurisdiction is our company's registered office.
10 Severability clause
In the event of a breach or invalidity of individual provisions, the remaining provisions shall remain effective and in force.
The parties shall endeavour to replace the invalid provision by another provision which comes as close as possible to the economic purpose of the
